Privacy Notice

Please read this privacy notice to understand how I use and protect the information that you provide to me.

Your information will be held by Peter Keegan Artist, Sole Trader.

The UK is a world leader in data protection and privacy. To comply with UK laws, I have to manage your personal information fairly, lawfully and transparently. This means that you are entitled to know how I intend to use any information you provide. You can then decide whether you want to give it to me in order that I may provide the product or service that you require.  In addition, my policies and procedures are regularly reviewed. My aim is to make sure that you have confidence in me and feel comfortable about giving me your information. I think that safely looking after your information is a key part of our relationship.

The information I have, from whom and why

When you commission me or buy one of my products you may provide me with some personal information including name, address, telephone number and email address.  Depending on your method of payment, you may also provide me with some of your bank details.  I collect this information so:

·         I can contact you with information relating to the product you have bought; be that information relating to portrait sitting or so that I may email you a receipt

·         I can process your payment

·         I can comply with regulations set by HMRC and Companies House regarding record keeping, taxation and company law

·         I can send direct marketing you about my future exhibitions, courses, classes, products, and events directly related to my work that I think you may be interested in (see below)

If I take your photograph, I will always ask for your verbal permission first.  I use photographs as reference material to paint from, for advertisement purposes, be that in printed literature, on my website or through social media and as references when I teach.  I will always ask for your consent before taking your photograph and I will always inform you of where and how I intend to use it.  You have the right to withdraw your consent at any time.

You have the right to decide not to give me some of the above information but by doing this, you understand that I may not be able to provide you with one of my products or services or I may not be able to work with you.

Direct Marketing

When you buy something from me, visit me in the studio, visit my website or see me at an event, I’ll offer you an opportunity to join my email mailing list.  I send out an email newsletter, on average six times a year, which includes my current news and details of my courses, classes and products.  I sometimes include information about related events happening at Claydon Estate or other venues.  I value our relationship, so I aim to only send you information I think may be of interest to you personally.  I’ll do this by email and will only send direct marketing to you in this way if you’ve consented to receive it.  You have the right to withdraw your consent at any time, either by clicking the “unsubscribe” button on my newsletter or contacting me by phone or email and letting me know. 

Passing your information to others

I will only disclose information where strictly necessary to comply with my legal obligations, including where HMRC or other authorities require it, for example with my accountant.

I will never share or give your information to anybody else.

How I store your information and for how long

I store any paper records in my studio in a locked cupboard which only myself and my wife and business partner, Kimberley Keegan, have access to.  I also store data on my computer which is password protected and I ensure I have the latest computer protection software installed and updated to offer the best level of protection I can. 

If you have bought something from me, I have a legal obligation to keep a record of that transaction for 7 years. 

Your Rights

You have the following rights:

Access

You have a right to ask me if I have your personal information and you have the right to a copy of the information I have. If I do, you have a right to know:

  • why I have it
  • what type of information I have
  • whether I have or will send it to others, e.g. our tutors or HMRC
  • how long I will keep it

Rectification

Where any of your information is incorrect, you have a right to tell me to correct it promptly. Please tell me as quickly as possible if you change your address or other contact details. If your information is incomplete, you can ask me to correct this too.

In certain circumstances, you’ll have the following extra rights:

Right to object

Depending on the legal basis for which I am using your information, you may be entitled to object. For example, where I’m using your information connected with marketing, I will stop if you object. However, if I’m using your information to meet certain legal obligations, I may continue to do so even if you object.

Erasure (right to be forgotten)

You may have a right to have some or all of the information I hold about you deleted.  However, you should be aware that I am required to retain some records i.e. invoices, to comply with the law.

With reference to photographs, the copyright of any finished artwork remains with the artist.  Therefore, once I have finished a portrait or commission, I will delete all the photographic reference images but any photographic images of the work itself, I am entitled to keep, display, exhibit and utilise for marketing purposes as I see fit.

Consent

If you consent to me using your information, you have the right to withdraw that consent at any time.
